The court granted anticipatory bail to the petitioner subject to bond and sureties, under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The petitioner, Malkit Kumar, sought anticipatory bail after being implicated in a case alleging robbery, theft, and molestation under several sections of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.). The prosecution alleged that the petitioner, along with two others, entered the informant's house and committed the offences. The petitioner contended that he was falsely implicated due to village politics and that no material evidence was recovered from him or the other accused. The State opposed the bail, arguing the seriousness of the charges. Considering the lack of evidence, the petitioner's clean record, and his willingness to cooperate, the court granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, with conditions under Section 482(2) of the B.N.S.

Issues considered

  • Whether anticipatory bail is appropriate in a case involving alleged robbery, theft, and molestation under the B.N.S.
  • Whether the petitioner poses a risk of fleeing, tampering with evidence, or influencing witnesses
  • Whether the allegations are based solely on suspicion without material evidence
