KARISHMA KUMARIversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner.

Summary

Karishma Kumari, the registered owner of a motorcycle, was implicated in a case alleging the seizure of 5.58 litres of Indian Made Foreign Liquor (IMFL) from the vehicle on 9 December 2025, leading to the arrest of her brother. The prosecution charged her under Sections 338 and 336(3) of the Bharatiya Nyaya Sanhita and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act. The petitioner contended that she was innocent, merely a female resident of the house, and that the motorcycle was regularly used by her brother, who was the one arrested. The court, after considering the submissions, found merit in granting her anticipatory bail. Accordingly, the application for anticipatory bail was allowed, subject to a bail bond of Rs.10,000 with two sureties and compliance with Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita. The order directed that if she is arrested or surrenders within four weeks, she be released on bail by the Special Judge (Excise) in Darbhanga.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the alleged offences under the Bharatiya Nyaya Sanhita and the Bihar Prohibition and Excise (Amendment) Act
  • Whether ownership of the motorcycle suffices to make the petitioner liable for the alleged contravention
