Decided
Disposal
ALLOWED

Holding

Anticipatory bail was granted to the petitioner subject to conditions.

Summary

The petitioner, Junaid Ansari, a 21‑year‑old, was implicated in a case under Section 25(1)(a) of the Arms Act for allegedly making a video of illegal arms go viral. He contended that he had no knowledge of any such video, no weapon was recovered from his possession, and he had not disseminated any such material. The State opposed his request for anticipatory bail, arguing the seriousness of the offence. The Court examined the facts, noting the petitioner’s lack of direct involvement, his cooperation, and his existing bail in another case. Considering these circumstances, the Court ordered that he be released on bail if arrested, subject to a bond of Rs 10,000 and two sureties, under Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023.
