Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner on furnishing a bond of Rs.10,000 with two sureties.

Summary

The petitioner, Md. Firdaush, was arrested in connection with a rape case (Biraul P.S. Case No.243 of 2025) under several provisions of the Bharatiya Nyaya Sanhita. He applied for bail, claiming innocence and highlighting contradictions in the victim's statements recorded under Sections 180 and 183 of the B.N.S.S., as well as noting that the alleged incident occurred in broad daylight. The petitioner also emphasized that the investigation was complete, he had no prior criminal record, and he had been in judicial custody since 20‑07‑2025. The State opposed bail, but the informant’s counsel stated that the parties had reached a compromise and restored cordial relations. Considering these factors, the court ordered bail on the condition of a Rs.10,000 bond with two sureties of equal amount.
