Patna High Court

Jitendra SahversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Bail was granted to the petitioner subject to bond and surety conditions.

Summary

The petitioner, Jitendra Sah, was arrested after 840 litres of liquor were recovered from a pick‑up vehicle in a case under the Bihar Prohibition and Excise Act. He claims to be merely the driver and asserts that he had no knowledge of the contraband, pointing out the absence of any incriminating material in his possession and his clean criminal record. The prosecution opposed bail, relying on the seriousness of the offences under Sections 30(a), 32(3) and 30(F). The court noted the petitioner’s lack of antecedents, the length of his pre‑trial custody, and the failure of the authorities to comply with Section 103 of the B.N.S.S., 2023. Consequently, the court granted bail on the condition of a Rs.15,000 bond with two sureties and compliance with procedural conditions.
