The Court allowed the anticipatory bail application, granting provisional bail subject to verification of the petitioner’s criminal antecedents.

Summary

The petitioner, Ajit Kumar Singh, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for allegedly recovering 1,800 litres of liquor. The petitioner argued that he was not arrested at the scene, the seized vehicle was not his, and the only evidence was a confessional statement made by an accused in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending the seriousness of the offence and the petitioner’s prior criminal antecedents. The Court examined these submissions and noted that the confessional statement could not be the sole basis for arrest, and that the petitioner’s antecedent record needed verification. Accordingly, the Court granted provisional anticipatory bail, subject to a bail bond of Rs.10,000 with two sureties and a six‑week surrender, and directed the trial court to confirm the bail after verifying that the petitioner has no more than two prior cases. The order was conditioned that if more than two antecedents are found, the provisional bail would not be confirmed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438(2) CrPC in a case involving alleged excise offences.
  • Whether a confessional statement made by an accused in police custody has evidentiary value for granting bail.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
