Patna High Court

Kesharinandan Ram @ Keshari RamversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

Anticipatory bail was granted to the petitioner subject to bail‑bond and surety conditions.

Summary

The petitioner, Kesharinandan Ram, brother‑in‑law of a deceased woman, was implicated in a dowry‑death case under Section 80(2) of the Bharatiya Nyaya Sanhita. He applied for anticipatory bail, asserting his innocence, clean antecedents and that the primary accused – the husband – was already in custody. The State and the informant opposed the bail. The court noted that the husband’s custody reduced the risk of the petitioner fleeing or tampering with evidence, and that the allegations against the petitioner were vague and over‑broad. Accordingly, the court granted anticipatory bail, subject to a bail‑bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 80(2) of the Bharatiya Nyaya Sanhita in a dowry‑death case
  • Whether the presence of the husband in custody justifies granting anticipatory bail to the petitioner
