BAIL GRANTED

Holding

Bail is to be granted to the petitioner subject to surrender within eight weeks and compliance with the conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Summary

The petitioner, Imam Ansari, was arrested in connection with a case alleging assault and threats against an informant and her family under multiple sections of the Bhartiya Nyaya Sanhita, 2023. He contended that the incident stemmed from a petty dispute between co‑villagers, resulting only in simple injuries and no overt act attributable to him. The State opposed his bail, citing the seriousness of the charges. The Court examined the nature of the injuries, the context of the dispute, and the lack of concrete evidence of a violent act by the petitioner. It held that bail could be granted provided the petitioner surrenders within eight weeks and complies with the stipulated conditions. Accordingly, the Court ordered bail on a bond of Rs 10,000 with two sureties, subject to conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.

Issues considered
