Patna High Court

The Court granted provisional anticipatory bail subject to verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Anant Kumar, sought anticipatory bail fearing arrest in a case under Sections 30(a) and (d) of the Bihar Excise Act concerning alleged recovery of 82 litres of liquor from a brewery. He argued that he was not caught in the act, no liquor was found in his possession, he was not named in the FIR, and the only basis for his implication was a confessional statement of a co‑accused made while in police custody, which he claimed lacked evidentiary value. The State opposed the bail, contending that the petitioner had a history of ten prior excise cases. The Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs. 50,000 with two sureties and appear before the trial court within six weeks. The order further directed that the trial court verify the petitioner’s criminal antecedent; if more than ten prior cases are found, the bail would not be confirmed, whereas confirmation would follow if the antecedent is limited to ten cases.

Issues considered

  • Whether anticipatory bail can be granted to the petitioner under the Bihar Excise Act.
  • Whether a confessional statement made by a co‑accused in police custody is admissible for implicating the petitioner.
  • Whether the police investigation complied with procedural requirements for arrest and charge.
