Patna High Court

Nandlal RaiversusThe State of Bihar

Decided
Disposal
DISPOSED

Holding

The Court conditionally granted provisional anticipatory bail to the petitioner, subject to bond, sureties, and verification of his criminal antecedent.

Summary

The petitioner, Nandlal Rai, feared arrest in a case under the Bihar Excise Act (Sections 30(a), 41, 32(2)) alleging recovery of 3,546 litres of liquor from various vehicles. He has 11 prior criminal cases, nine of which are excise offences, and claims he was not caught in possession of any seized vehicle and is not its owner. The prosecution’s case rests mainly on a confessional statement of another accused, which the petitioner argues lacks evidentiary value. The State opposed his request for anticipatory bail. The High Court, applying Section 482(2) of the BNSS, granted provisional anticipatory bail conditioned on a bail bond of Rs.55,000 with two sureties and directed the trial court to verify his antecedent; if more than 11 cases are found, the bail may be cancelled.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail despite the serious nature of the excise offences.
  • Whether a confessional statement of another accused can justify arrest and denial of bail.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail under Section 482(2) of the BNSS.

submitted that once an accused is implicated in a case relating to
