Holding
Anticipatory bail is granted conditionally, subject to verification of the petitioner’s antecedent and compliance with Section 438(2) CrPC.
Summary
The petitioner, Bhim Yadav, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for the alleged recovery of 20 litres of liquor from his motorcycle. He argued that he has a clean antecedent, was not in possession of the liquor at the time of seizure, and was implicated merely because he owned the vehicle. The State opposed the bail, contending that the alleged offence warranted arrest. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his antecedent and compliance with Section 438(2) conditions. The order stipulated that if any criminal antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application for anticipatory bail was allowed conditionally.
Issues considered
- Whether anticipatory bail should be granted under Section 438 CrPC for an offence under Section 30(a) of the Excise Act.
- Whether ownership of the vehicle used in the alleged offence justifies arrest and denial of bail.
- Whether the petitioner’s claim of a clean antecedent affects the grant of anticipatory bail.
