The court held that the petitioners are entitled to bail as continued detention would amount to punitive pre‑trial incarceration violating Article 21.
Summary
The petitioners, Munna Das and Sanjeet Das, were arrested in connection with Nadi Police Station Case No. 330 of 2024 under Sections 103(1) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. Both have been in custody for several months without any witness examination or trial progress, and they have no prior criminal record. Their earlier applications for regular bail were rejected by a coordinate bench of the same court. They argued that continued pre‑trial detention violates their fundamental right to liberty under Article 21 of the Constitution. The State opposed the bail, but the court found that the prolonged detention served no purpose other than punitive pre‑trial incarceration. Consequently, the court granted bail to both petitioners on the condition of a cash bond and sureties, with requirements to appear at every trial date.
Issues considered
- Whether the petitioners are entitled to regular bail despite the pending trial under the Bharatiya Nyaya Sanhita, 2023.
- Whether continued pre‑trial detention infringes Article 21 of the Constitution of India.
