Patna High Court

Chandan PaswanversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court held that the petitioners are entitled to anticipatory bail subject to the conditions laid down under Section 482(2) of the B.N.S.S.

Summary

The petitioners, four Paswan brothers, feared arrest in a case registered under Sections 191(2), 190, 126(2), 117(2), 109, 76, 352 and 351(2) of the B.N.S., 2023, arising from an altercation at Maa Kali Temple where they allegedly objected to others sitting in the temple on the basis of their belief in Ambedkar. The petitioners claimed they have clean antecedents and that the informant’s allegations are false, noting that a counter‑case (Karamchat P.S. Case No.93 of 2025) has been filed against the informant. The State opposed the anticipatory bail application. After hearing both sides, the Court granted anticipatory bail, directing the petitioners to surrender within six weeks, furnish bail bonds of Rs 10,000 each with two sureties, and comply with conditions under Section 482(2) of the B.N.S.S.

Issues considered

  • Whether the petitioners are entitled to anticipatory bail in the pending criminal case.
  • Whether the allegations against the petitioners constitute false implication.
  • Whether the conditions prescribed under Section 482(2) of the B.N.S.S. are satisfied.
