Patna High Court

Pradeep ManjhiversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioners subject to conditions under Section 482(2) of the BNSS.

Summary

The petitioners, four brothers named Manjhi, sought anticipatory bail fearing arrest in a case registered under several offences of the Bharatiya Nyaya Sanhita. They asserted they have clean antecedents and alleged that the informant’s allegations were vague, exaggerated, and that they were falsely implicated. The State opposed the bail, arguing the seriousness of the offences. The court examined the specificity of the allegations, the petitioners’ background, and the risk of them fleeing or tampering with evidence. Relying on Section 482(2) of the BNSS, the court granted anticipatory bail subject to a cash bond of Rs.10,000 and two sureties, with standard conditions. The order was pronounced by Justice Satyavrat Verma.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita.
  • Whether the allegations in the FIR are specific and serious enough to deny bail.
  • Whether the petitioners pose a risk of fleeing, influencing witnesses, or tampering with evidence.

                                       ORAL ORDER

2 20-01-2026 1. Heard learned counsel for the petitioners and

                   learned A.P.P. for the State.

                             2. The petitioners apprehend their arrest in a case

registered for the offences punishable under Sections 126(2),

                   115(2), 118(1), 109, 329(3), 352, 351(2) and 3(5) of the

                   Bharatiya Nyaya Sanhita.

                             3. Learned counsel for the petitioners submits that the

petitioners are persons with clean antecedent and the informant

alleges that accused persons on 24-7-2025 at 7 pm came to her

house and started abusing, on protest Jagdish assaulted her by

farsa causing injury on head, thereafter Pradip and Amrit

assaulted her by lathi all over her body and Manjit assaulted her

aunt by lathi causing injury on head.

                   4. Learned counsel for the petitioners submits that

petitioners have been falsely implicated in the instant case by

the informant. It is next submitted that from perusal of the

allegations as alleged in the FIR, it would manifest that no

specific allegation is alleged against the petitioners except

petitioner no. 2, who is alleged to have assaulted the aunt of the

informant by lathi causing injury on head, but then the injury

has been opined to be simple in nature. It is further submitted

that specific allegation of assaulting the informant by farsa is

against Jagdish, but Jagdish is not the petitioner and as far as

allegation against Pradip and Amrit is alleged, the same is not

specific rather it is alleged that they assaulted the informant by

lathi all over the body, but then the said allegation is an

exaggerated allegation. It is also submitted that from side of the

petitioner, Baikunthpur PS Case No. 277 of 2025 has been

instituted against the informant and her side alleging that

informant and her side had asked the petitioners to sow the

seeds in the field but on account of rain, the seeds could not be

sowed, as such the side of the informant came and assaulted
