BAIL GRANTED

Holding

The Court granted anticipatory bail to the petitioners subject to bond and surety conditions under Section 482(2) of the BNSS.

Summary

The petitioners, Ravi Kumar and Mukesh Kumar, were implicated in a case (PS Parbatta Case No. 261 of 2025) alleging multiple offences under the Bharatiya Nyaya Sanhita, including assault and rioting. The informant, who is an agnate of the petitioners, claimed that the petitioners assaulted him and others during a land‑related altercation on 11‑7‑2025. The petitioners contended that they have clean antecedents, were falsely implicated due to a land dispute, and that the injuries described were either simple or not caused by them. They applied for anticipatory bail to avoid arrest, while the State opposed the relief. The Court, after considering the submissions, granted anticipatory bail subject to a bond of Rs.10,000 and two sureties, invoking Section 482(2) of the BNSS. The order was pronounced by Justice Satyavrat Verma of the Patna High Court.

Issues considered

  • Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the Bharatiya Nyaya Sanhita in view of the alleged offences and the claim of false implication.
