SANTOSH SAHNIversusThe State of Bihar

The court allowed the anticipatory bail application, granting provisional bail subject to bond, sureties and verification of antecedent.

Summary

Santosh Sahni applied for anticipatory bail under Section 438 of the CrPC in connection with a case under Section 30(a) of the Excise Act, alleging recovery of 11.9 litres of liquor from his joint family house. He argued that he has a clean antecedent, the liquor was not in his conscious possession, and the recent amendment to the Excise Act has done away with the concept of deemed possession. The State opposed the bail. The High Court, after considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnishes a bail bond of Rs.500 with two sureties and that the trial court verify his antecedent. If any prior case is found, the bail may be revoked; otherwise, it will be confirmed.

Issues considered

  • Whether anticipatory bail can be granted when possession of liquor under Section 30(a) Excise Act is not established.
  • Effect of the 2018 amendment removing deemed possession on the grant of anticipatory bail.
  • Whether the petitioner’s criminal antecedent influences the confirmation of anticipatory bail.
