The Court held that anticipatory bail may be granted subject to conditions under Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

Petitioner Pintu Chauhan sought anticipatory bail after learning that he was implicated in a case under multiple sections of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.) for an alleged attack on police personnel that resulted in an injury to an Assistant Sub-Inspector. The prosecution alleged that 22 named and several unknown accused attacked the police, but the petitioner claimed he was not present at the scene, had no specific allegation against him, and was named only through a disclosure by a mahal chaukidar. He asserted his innocence, lack of criminal antecedent, and willingness to cooperate with the investigation. The State opposed the bail, arguing the seriousness of the offences. The Court, after considering the submissions, granted anticipatory bail on the condition that the petitioner surrender or be arrested within six weeks, provided he furnishes a bail bond of Rs.10,000 with two sureties, subject to Section 482(2) of the B.N.S., 2023.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under the Bharatiya Nagarik Suraksha Sanhita in view of the alleged offences.
  • Whether the prosecution has produced sufficient material to justify denial of anticipatory bail.
