Anticipatory bail was granted to the petitioners subject to bond and conditions under Section 482(2) of the B.N.S.
Summary
Four individuals (Navneet Kumar Singh, Richa Kumari, Tanu Kumari and Rishav Kumar) applied for anticipatory bail fearing arrest in a case registered under multiple sections of the Bharatiya Nagarik Suraksha Sanhita (B.N.S.). The prosecution alleged that they assaulted an informant with a sword, inflicted a facial injury, snatched a gold chain and attempted strangulation. The petitioners contended that the informant had previously assaulted Tanu Kumari to pressure a separate criminal case and that they have no prior criminal record. The court examined the seriousness of the alleged offences against the petitioners’ cooperation, lack of antecedents and the counter‑allegations. Relying on Section 482(2) of the B.N.S., the court held that anticipatory bail could be granted subject to conditions. Accordingly, the petitioners were ordered to furnish a bail bond of Rs 10,000 each with two sureties if arrested within six weeks, and to comply with the stipulated conditions.
Issues considered
- Whether anticipatory bail should be granted to the petitioners under Section 482(2) of the B.N.S. despite the nature of the alleged offences
- Whether the allegations of assault, theft and attempted strangulation justify denial of bail
- Whether the petitioners’ lack of criminal antecedent and willingness to cooperate warrant bail
