The court held that provisional anticipatory bail may be granted under Section 438 CrPC when the petitioner demonstrates a clean antecedent and no arrest, subject to subsequent verification of his criminal record.

Summary

Petitioner Rajnandan Bhagat applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 100 litres of liquor from a public canal. The petitioner claimed he had a clean antecedent, was not arrested at the spot, and that the alleged liquor was not in his possession. The State opposed the bail. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to verification of his criminal antecedent. The order stipulated that if any antecedent is discovered, the bail would be cancelled; otherwise, it would be confirmed. The application was allowed.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Excise Act.
  • Whether the petitioner’s clean antecedent and lack of arrest justify the grant of anticipatory bail.
  • Whether the involvement of the watchman (chaukidar) affects the merits of the bail application.

at the instance of Chaukidar, but then, tt is submitted that if

Chaukidar was aware of the involvement of the petitioners in
