BAIL GRANTED

Holding

The court granted anticipatory bail to the petitioner subject to the conditions prescribed under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Summary

Manish Kumar sought anticipatory bail fearing arrest in a case involving the seizure of 2,275.200 litres of liquor, alleged under Section 30(a) of the Bihar Prohibition and Excise Act and sections 319(2) and 111(3) of the Bharatiya Nyaya Sanhita. The prosecution alleged the liquor was recovered from a truck, while the petitioner contended that his name was linked only through a confessional statement of another apprehended individual and that he was neither the owner nor driver, having no criminal antecedent. He also argued that Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, had not been complied with, rendering the case prima facie weak. The State opposed the bail. The court, after considering the submissions, granted anticipatory bail on the condition that the petitioner surrenders within six weeks, furnishes a bail bond of Rs.15,000 with two sureties, and complies with conditions under Section 482(2) of the Bharatiya Nagarika Suraksha Sanhita, 2023.

Issues considered

  • Whether anticipatory bail is warranted in the absence of a prima facie case against the petitioner
  • Whether the non‑compliance of Section 103 of the Bharatiya Nagarika Suraksha Sanhita, 2023, precludes the grant of bail
  • Whether the petitioner’s alleged involvement, based solely on another’s confessional statement, suffices for arrest

                                  6. Considering the aforesaid facts and circumstances

of the case, let the petitioner above named, in the event of

arrest/surrender before the learned Court below within a period

of six weeks from today, be released on anticipatory bail on
