Anticipatory bail was granted to the petitioner subject to a bail bond and conditions under Section 482(2) of the B.N.S.S.
Summary
Parasnath Singh applied for anticipatory bail after being implicated in a case alleging assault with an iron rod, sword and lathi, resulting in injuries to an informant and his relatives. The petitioner claimed a clean antecedent and argued that the informant's injury was simple and the allegations were exaggerated, arising from a land dispute involving a telecom tower. The State and the informant opposed the bail, contending the seriousness of the offences and a pending case against the informant. The court examined the submissions, the nature of the alleged injuries, and the petitioner’s background. It ordered that the petitioner be released on anticipatory bail, subject to a bond of Rs.10,000 with two sureties and conditions under Section 482(2) of the B.N.S.S., provided he surrenders within six weeks.
Issues considered
- Whether anticipatory bail should be granted to the petitioner in view of the alleged offences under Sections 126(2), 115(2), 117(2), 109, 302(2) and 3(5) of the B.N.S., 2023.
- Whether the alleged injury to the informant justifies denial of bail.
- Whether the petitioner’s clean antecedent and the claim of false implication warrant bail.

ORAL ORDER
2 29-01-2026 Heard learned counsel for the petitioner, learned APP
for the State as well as learned counsel appearing on behalf of
the informant.
2. Petitioner apprehends his arrest in a case registered
for the offences punishable under Sections 126(2), 115(2),
117(2), 109, 302(2) and 3(5) of B.N.S., 2023.
3. Learned counsel for the petitioner submits that
petitioner is a person with clean antecedent and the informant
alleges that accused persons including the petitioner came on
04.09.2025 at 04:00 p.m. and petitioner assaulted him by an iron

Kumar and Sonu Kumar came to save him, accused persons

snatched chain of Bhushan.
4. Learned counsel for the petitioner submits that
petitioner has been falsely implicated in the instant case by the
informant on account of dispute relating to land. It is next
submitted that the informant though is a senior citizen but very
wisely settled the land of the petitioner with a Telecom company
for setting up a tower and when petitioner and his side came to
know about the said settlement, they approached the Telecom
company and the Telecom company after being satisfied that the
land belongs to the petitioner and his side, settled the issue by
agreeing to pay the rent to the petitioner and his side, on account
of which, an altercation took place in which both sides assaulted
each other. It is further submitted that no doubt there is specific
allegation of assault against the petitioner of assaulting the
informant causing fracture of hand but then the injury suffered
by the informant has opined to be simple, as such, allegation of
assault causing fracture of hand is exaggerated to give
seriousness to the case. It is also submitted that petitioner is not
a criminal.
5. Learned APP for the State and learned counsel
appearing on behalf of the informant opposes the anticipatory
bail application. Learned counsel for the informant is not in a

position to rebut the submission of the learned counsel
appearing on behalf of the petitioner that the injury suffered by
the informant has opined to be simple in nature. It is also
submitted that from the side of the petitioner Bihta P.S. Case
No.706 of 2025 has been instituted against the informant and his
side.
6. Considering the submissions made by the learned
counsel for the petitioner, let petitioner, above-named, in the
event of his arrest or surrender before the learned trial court
within a period of six weeks from today, be released on
anticipatory bail on furnishing bail bonds of Rs.10,000/-
(Rupees Ten Thousand) with two sureties of the like amount
each to the satisfaction of the learned trial court where the case
is pending/Successor Court in connection with Bihta P.S. Case
