Provisional anticipatory bail is granted subject to conditions and verification of the petitioner’s criminal antecedent.

Summary

The petitioner, Devnandan Sah, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case under Section 30(a) of the Excise Act, alleging the recovery of 1304.4 litres of liquor from a pick‑up vehicle. The petitioner claimed he was not arrested at the spot, had no conscious possession of the liquor, was not the owner of the vehicle, and that the case was based on a confessional statement of another accused, which he argued lacked evidentiary value. The State opposed the bail, citing the petitioner’s antecedent of four prior Excise cases. The Court granted provisional anticipatory bail, directing the petitioner to furnish bail bonds of Rs 20,000 with two sureties, and conditioned the order on verification of his criminal antecedent; if more than four cases are found, the bail will not be confirmed. The order was made subject to the conditions of Section 438(2) CrPC and the trial court’s verification.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence punishable under Section 30(a) of the Excise Act.
  • Whether the petitioner’s antecedent of four prior Excise cases precludes the grant of anticipatory bail.
  • Whether a confessional statement of another accused, without further investigation, can form the basis for denying anticipatory bail.
