Patna High Court

Raj Kishore Kumar @ Raj Kishore PrasadversusThe State of Bihar

Holding

The Court granted regular bail to the petitioner.

Summary

The petitioner, Raj Kishore Kumar, was charged under several sections of the Bharatiya Nyaya Sanhita for allegedly stabbing an informant, causing a simple injury. He had been in custody since 19 February 2025 and claimed innocence, asserting that he was falsely implicated and had no prior criminal record. The State opposed his regular bail application, arguing the seriousness of the charges and that the charge had already been framed. The Court considered the framing of charge, the petitioner’s clean antecedent, the nature of the injury, and the lack of risk of evidence tampering or absconding. Accordingly, the Court ordered his release on regular bail upon furnishing a bond of Rs.10,000 with two sureties, subject to the satisfaction of the Sub‑Divisional Judicial Magistrate, Danapur.
