The Court grants bail to the petitioners subject to a bond and conditions.
Summary
The petitioners, Imran Khan and Azad Khan, were arrested in Buxar for alleged possession of 3078.42 litres of foreign liquor, charged under several sections of the Bharatiya Nyaya Sanhita. They contended that no incriminating material was found on them, that they were merely the driver and co‑pilot, and that the police had acted arbitrarily, noting a clean criminal record and a lack of compliance with Section 103 of the BNSS. The State opposed bail. Considering the prolonged custody since 11 October 2025, the absence of direct evidence, and the petitioners’ antecedents, the Court decided to grant bail. The bail order required a bond of Rs 15,000 with two sureties, one of whom must be a close family member, and mandated appearance at every trial date, with cancellation possible after two consecutive defaults. The petition was thus disposed with bail granted subject to conditions.
Issues considered
- Whether bail should be granted to the accused under the Bharatiya Nyaya Sanhita given the nature of the offences and the circumstances of arrest
- Whether the prosecution has complied with the requirements of Section 103 of the BNSS for bail denial
