Decided
Disposal
BAIL GRANTED

Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Raghunath Sahni, was arrested in connection with a case under Section 30(a) of the Bihar Prohibition and Excise Act after 640.2 litres of liquor were recovered from a co‑accused's house. He claimed innocence, stating that no incriminating material was found on his person, he was not named in the FIR, and he has no prior criminal record. The prosecution opposed bail, relying on the co‑accused’s disclosure linking the petitioner to the seizure. The court noted the petitioner’s clean antecedent, short period of custody, and the lack of compliance with Section 103 of the B.N.S.S., 2023, and decided to grant bail. Bail was ordered on a bond of Rs.15,000 with two sureties of the same amount.
