Patna High Court

Arvind Sahani @ Arvind Kr. SahniversusThe State of Bihar

DISPOSED

Holding

The court allowed the anticipatory bail application, granting provisional anticipatory bail subject to conditions and verification of antecedents.

Summary

The petitioner, Arvind Sahani, feared arrest in a case registered under Sections 274, 275 and 3(5) of the B.N.S., 2023 and Section 30(a) of the Bihar Prohibition and Excise Act, alleging recovery of 97.66 litres of liquor from a motorcycle. He contended that he was not arrested on the spot, did not possess the seized vehicle, and was implicated by a police informant, while also noting he had only one prior criminal case. The State opposed his anticipatory bail application. The High Court, after hearing both sides, granted provisional anticipatory bail on the condition of a Rs.5,000 bail bond, two sureties, and verification of his criminal antecedents. The order stipulated that if more than one antecedent is found, the bail would not be confirmed; otherwise, it would be confirmed immediately. The petitioner also agreed to deposit Rs.2,500 with the Lawyers’ Association within two weeks.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner despite the alleged offences under the B.N.S., 2023 and the Bihar Prohibition and Excise Act.
  • Whether the petitioner’s prior criminal antecedent affects the grant of anticipatory bail.
