Holding
The Court granted provisional anticipatory bail to the petitioner subject to specified conditions.
Summary
Mukesh Chaudhary applied for anticipatory bail after learning that he may be arrested in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022, alleging recovery of 27 litres of liquor from his jointly owned house. He argued that he was not arrested on the spot, had no conscious possession, and that the concept of deemed possession was abolished by the 2018 amendment, making it uncertain that he kept the liquor. The State opposed the bail. The Court, considering his clean antecedent and the factual circumstances, granted provisional anticipatory bail subject to a bail bond of Rs.500 with two sureties, verification of his criminal record, and a deposit of Rs.1,500 with the Patna High Court Advocate Association. The order is conditional on the trial court’s verification of his antecedents, after which the bail may be confirmed or revoked.
Issues considered
- Whether anticipatory bail can be granted in a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022
- Whether the doctrine of deemed possession applies post‑2018 amendment of the Excise Act
- Whether joint family ownership of the premises negates presumption of possession by the petitioner
- Whether the petitioner’s clean antecedent warrants the grant of anticipatory bail

would be presumed that petitioner had concealed his antecedent

that event the provisional anticipatory bail order shall not be
confirmed but if it is found on verification that petitioner is a
