Ownership of the vehicle from which contraband was seized does not, by itself, preclude the grant of anticipatory bail, and provisional anticipatory bail was therefore ordered subject to verification of antecedents.

Summary

The petitioner, Kunti Devi, applied for anticipatory bail under Section 438 of the Cr.P.C. after a seizure of 1080 kg of mahua flower from a motorcycle she owned, alleged to be in violation of Section 30(c) of the Excise Act. She argued that she was not present at the spot, had no conscious possession of the contraband, and possessed a clean antecedent, emphasizing her status as a woman. The State opposed the bail, contending the seriousness of the offence. The Court considered that mere ownership of the vehicle does not constitute sufficient grounds to deny bail and, after evaluating the petitioner's clean record, granted provisional anticipatory bail subject to verification of antecedents and compliance with bail conditions. The order directs the trial court to confirm the bail if no prior cases are found, otherwise to revoke it.

Issues considered

  • Whether the petitioner is entitled to anticipatory bail under Section 438 Cr.P.C. in a case involving alleged contravention of Section 30(c) of the Excise Act.
  • Whether ownership of the vehicle from which the contraband was seized justifies denial of anticipatory bail.

                                2. The petitioner seeks bail in anticipation of her

arrest in a case registered for the offences punishable under

Section 30(c) of the Excise Act.

                                3. The learned counsel for the petitioner submits that

the petitioner is a person with clean antecedent and is a woman

                                4. The learned counsel for the petitioner submits that

petitioner was not arrested from the spot, as such, nothing was

recovered from her conscious possession and she came to be

implicated based on the fact that she is owner of the seized

vehicle. It is next submitted that no prudent person would use

evidence against herself and hence, would get implicated. It is

also submitted that it is not the case of the prosecution that they

sum of Rs.500/- (Rupees Five Hundred) with two sureties of the

like amount each to the satisfaction of the learned Trial Court

where the case is pending/successor Court in connection with

Rafiganj P. S. Case No.747 of 2024, subject to the conditions

laid down under Section 438(2) of the Cr.P.C.

                       7. The application stands allowed.

                       8. It is made clear that the learned trial Court after

accepting the provisional bail bonds of the petitioner shall verify
