Holding
The Court granted provisional anticipatory bail with conditions, pending verification of the petitioner’s criminal antecedent.
Summary
Rampukar Sah sought anticipatory bail after the police registered a case under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022 alleging that 10 litres of liquor were recovered from a motorcycle and 25 litres from a house linked to him. The petitioner argued that he was not in actual possession, did not own the vehicle, the house was joint‑family property and he had no knowledge of the liquor, and that the concept of deemed possession had been removed by the 2018 amendment. The State opposed the bail. The Court, after considering the submissions, granted provisional anticipatory bail subject to a bond of Rs 5,000 with two sureties and conditions under Section 438(2) of the Cr.P.C. and Section 482(2) of the BNSS, directing the trial court to verify the petitioner’s criminal antecedent before confirming the bail. If more than one prior case is found, the bail will not be confirmed; if only one, it will be confirmed forthwith.
Issues considered
- Whether anticipatory bail can be granted in a case of alleged liquor possession under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2022.
- Whether the petitioner’s lack of ownership of the vehicle and joint‑family status of the house negate presumed possession.
- Whether the amendment removing the concept of deemed possession affects bail considerations.
