Holding
The petitioner is entitled to bail subject to the conditions stipulated by the Court.
Summary
The petitioner, Ravindra Sah, sought bail after being implicated in a criminal case (PS Case No. 291 of 2025) for offences under the Bhartiya Nyaya Sanhita, 2023 and the Information Technology Act, 2000. He contended that the specific allegation of threatening and sending an obscene video pertained only to his son, co‑accused Akash Kumar Sah, and that he was named merely because of his relationship to the co‑accused. The State opposed the bail application. The Court examined the FIR and noted the absence of any direct allegation against the petitioner and his clean antecedents. Accordingly, the Court ordered that the petitioner be released on bail, provided he surrenders within eight weeks, furnishes a bail bond of Rs 10,000 with two sureties of equal amount, and complies with conditions under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
Issues considered
- Whether the petitioner, who is not directly alleged to have committed the offences, is entitled to bail.
- Whether the petitioner’s familial relationship to a co‑accused justifies his inclusion as an accused.
- Whether the conditions imposed under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 are appropriate for bail.

from perusal of F.I.R., it is apparent that specific accusation of

on whatsapp of informant is against co-accused Akash Kumar

because he happens to be father of co-accused Akash Kumar
Sah. There is absolutely no allegation against this petitioner and
he claims clean antecedent.
