The court allowed the anticipatory bail, directing provisional bail with conditions and verification of antecedents.

Summary

The petitioner, Rajesh Sahani, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 21 litres of liquor. He argued that he was not arrested at the scene, the liquor was recovered from a premises not belonging to him, and the FIR did not disclose the informant, casting doubt on the prosecution's case. The State opposed the bail, citing the petitioner’s three prior excise cases. The High Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.15,000 with two sureties, subject to verification of his criminal antecedents. The order stipulated that if more than three prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC for alleged offences under Section 30(a) of the Excise Act.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
