The Court granted provisional anticipatory bail subject to bail bonds and verification of antecedents.

Summary

The petitioner, Mannu Kumar, applied for anticipatory bail under Section 438(2) of the Criminal Procedure Code in connection with a case registered under Section 30(a) of the Excise Act for alleged recovery of 160 litres of liquor from a banana orchard adjacent to his house. The petitioner argued that he was not arrested at the spot, no liquor was found in his possession, and the FIR did not disclose the informant, casting doubt on the prosecution's case. The State opposed the anticipatory bail, contending the seriousness of the offence. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.10,000 with two sureties, subject to verification of his criminal antecedents. The order stipulated that if more than two prior cases are found, the bail would not be confirmed; otherwise, it would be confirmed forthwith.

Issues considered

  • Whether anticipatory bail can be granted under Section 438 CrPC for an offence under Section 30(a) of the Excise Act where the accused is not in immediate possession of the contraband.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
