Holding

The Court allowed the anticipatory bail application, granting provisional bail subject to conditions and verification of antecedent.

Summary

The petitioner, Sita Devi, applied for anticipatory bail under Section 438 of the Criminal Procedure Code in connection with a case alleging offences under Sections 30(a), 41(1) and 41(2) of the Excise Act involving the recovery of liquor from a field adjacent to her house and from a truck linked to her motorcycle. The petitioner argued that she has a clean antecedent, is a woman, and that the seized liquor was not in her conscious possession nor on her property, and that she was unaware of any misuse of her vehicle. The State opposed the bail, contending the seriousness of the offences. The Court, after considering the submissions, directed that the petitioner be released on provisional anticipatory bail upon furnishing bail bonds of Rs.500 with two sureties, subject to the conditions of Section 438(2) CrPC and verification of her antecedent. The order stipulated that if any criminal antecedent is discovered, the bail would not be confirmed; otherwise, it would be confirmed forthwith. The application was allowed.

Issues considered

  • Whether anticipatory bail should be granted to the petitioner under Section 438 CrPC.
  • Whether the petitioner’s alleged involvement in the alleged liquor seizure warrants denial of bail.
  • Whether the petitioner’s clean antecedent and lack of conscious possession affect the bail decision.
