Holding

The court held that bail should be granted to the petitioner.

Summary

The petitioner, Sukesh Kumar, a 20‑year‑old resident of Darbhanga, was arrested in connection with an alleged assault, robbery and attempted murder that occurred on 31‑Oct‑2025. The prosecution’s case is based solely on the confessional statement of a co‑accused, with no material evidence recovered from the petitioner and his name not appearing in the FIR. The petitioner contended that he was falsely implicated, highlighted a seven‑day delay in filing the FIR, and emphasized his clean criminal record. The State opposed bail, arguing the seriousness of the offences under Section 309(4) of the Bharatiya Nyaya Sanhita. The court, considering the petitioner’s young age, lack of incriminating evidence, clean antecedent and the delay in the FIR, granted bail on a bond of Rs.10,000 with two sureties. The order was pronounced by Justice Sunil Dutta Mishra of the Patna High Court.

Issues considered

  • Whether bail should be granted to the accused under Section 309(4) of the Bharatiya Nyaya Sanhita in view of the alleged offences and the evidentiary material.
  • Whether the delay in lodging the FIR and the absence of material evidence against the petitioner justify bail.

          informant.

                       4. Learned counsel for the petitioner submits that

petitioner is innocent and has falsely been implicated in the

present case. Further submission is that petitioner is not named

in the F.I.R.. His name has been transpired on the basis of

confessional statement of co-accused Sunil Kumar Pandit.

Nothing incriminating material has been recovered from the

conscious possession of the petitioner. Except the confessional

petitioner. He next submits that there is an unexplained delay of

seven days in lodging the FIR, which creates serious doubt over

the veracity of the prosecution case. Charge-sheet has already

been submitted. Petitioner is a young boy of 20 years, having no

criminal antecedent and he is in custody since 18.11.2025.

named petitioner be released on bail on furnishing bail bond of

Rs. 10,000/- (ten thousand) with two sureties of the like amount
