The Court allowed the anticipatory bail application, granting provisional bail subject to bond and verification of antecedents.

Summary

Ravi Soni applied for anticipatory bail after a FIR was lodged under Section 30(a) of the Excise Act alleging that 25.02 litres of liquor were recovered from a motorcycle linked to him. He argued that he was not arrested at the scene, did not have the liquor in his conscious possession, and was not the owner of the vehicle, claiming that the watchman’s information led to his implication. The State opposed the bail, contending that the allegations warranted detention. The Court, considering the submissions, granted provisional anticipatory bail on the condition that the petitioner furnish a bail bond of Rs.10,000 with two sureties and appear before the trial court within six weeks. The order was made subject to verification of the petitioner’s criminal antecedent, with a provision to cancel bail if more than two prior cases are found.

Issues considered

  • Whether anticipatory bail should be granted under Section 438(2) of the Cr.P.C. in a case involving alleged possession of liquor under the Excise Act.
  • Whether the petitioner’s lack of arrest at the spot and non‑ownership of the seized vehicle justify bail.
  • Whether the petitioner’s prior criminal antecedents affect the grant of anticipatory bail.
