Patna High Court

Yogendra Yadav @ PanditversusThe State of Bihar

Decided
Disposal
BAIL GRANTED

Holding

The Court granted bail to the petitioner.

Summary

The petitioner, Yogendra Yadav, was arrested in connection with the recovery of 225 litres of liquor from a plastic sac near a pond, alleged under Section 30(a) of the Bihar Prohibition and Excise Act. The prosecution’s case relied on a local chowkidar’s disclosure, but no incriminating material was found in the petitioner’s possession. The petitioner claimed innocence, highlighted the open nature of the recovery site, and noted a single prior criminal antecedent and lack of compliance with Section 103 of the B.N.S.S., 2023. After hearing both sides, the Court considered the length of custody since 16‑11‑2025 and the absence of direct evidence. The Court decided to grant bail, ordering a bond of Rs.15,000 with two sureties of the same amount.

Issues considered

  • Whether bail should be granted to the accused under Section 30(a) of the Bihar Prohibition and Excise Act given the circumstances of the case.
  • Whether the lack of incriminating material and the open nature of the recovery site justify bail despite a prior criminal antecedent.
  • Whether compliance with Section 103 of the B.N.S.S., 2023 is required before granting bail.
