Holding
The Court ordered the District Magistrate‑cum‑Collector to take action to protect the petitioner’s property, finding that the State’s failure to safeguard the constitutional right to property warranted the issuance of the writ.
Summary
The petitioner, Khalilur Rahman, claimed ownership of a 0.14‑decimal land parcel in Katihar, purchased by a registered deed in 1965 and recorded in the revenue records. He alleged that neighbouring occupants (respondents 9‑27) were unlawfully disturbing his peaceful possession and that various state officials, including the District Magistrate and police, failed to intervene. Relying on the constitutional guarantee of property rights under Article 300‑A, he sought a writ directing the authorities to protect his land and restrain further interference. The Court held that the State’s inaction violated the petitioner’s constitutional right and therefore issued a writ directing the District Magistrate‑cum‑Collector to take immediate protective action. The writ petition was disposed of, granting the relief sought.
Issues considered
- Whether the State authorities’ failure to act infringes the petitioner’s right to property under Article 300‑A of the Constitution.
- Whether a writ can be issued directing the District Magistrate‑cum‑Collector to protect the petitioner’s possession and restrain encroachment.
- Whether the petitioner is entitled to protection despite not being formally dispossessed.

who are adamant to grab the land by taking law in their own
hands. Petitioner has approached several authorities, like the
District Magistrate, Sub-Divisional Officer and police officials
but they have not stopped the unauthorized action of the
neighbours of the petitioner, who has been impleaded as
respondents no.9 to 27 in the present writ petition. Petitioner has
not admitted in the present writ petition that he has been

District Magistrate-cum-Collector, Katihar is directed to
