High Court of Gujarat

DHAVAL JIVANBHAI PUNJABHAI RATHODversusSTATE OF GUJARAT

Disposal
28-REJECTED @ ADM.STAGE

Holding

The court denied temporary bail to the applicant.

Summary

The applicant, Dhaval Jivanbhai Punjab... Rathod, applied for temporary bail while his criminal trial under the Indian Penal Code was nearing completion, with only two witnesses and the investigating officer yet to be examined. The de facto complainant, Daxaben, opposed the bail. The court noted that the applicant had previously been released in October 2025 and had absconded for twelve days, and his conduct in jail was unsatisfactory. Considering these factors, the court found no sufficient ground to grant bail. Consequently, the application for temporary bail was rejected and the order was directed to be communicated to the jail authorities.

Issues considered

  • Whether temporary bail should be granted when the trial is near completion and only a few witnesses remain.
  • Whether the applicant's prior absconding and unsatisfactory jail conduct justify denial of bail.
