The court granted anticipatory bail to the applicant with specified conditions.

Summary

The High Court considered an anticipatory bail application filed by Sarthak, a student accused of raping a 16‑year‑old girl under Sections 64(2)(m) and 351(2) of the Bharatiya Nyaya Sanhita, 2023 and Sections 4, 8 and 12 of the POCSO Act, 2012. The prosecution alleged that the applicant forcefully sexually assaulted the minor and threatened her, while the applicant contended that the relationship was consensual and the victim, being 16, could understand the consequences. The mother of the victim, who was the first informant, expressed no objection to granting bail. The court examined the facts, the age of the victim, and the statutory provisions, and concluded that bail could be granted subject to strict conditions to prevent tampering with evidence or influencing witnesses. Accordingly, the court ordered the applicant to be released on anticipatory bail upon furnishing a bond and complying with several conditions, and disposed of the application.

Issues considered

  • Whether anticipatory bail can be granted under Section 482 of the BNSS for offences punishable under the BNS and POCSO Act.
  • Whether the alleged consensual nature of the relationship and the victim's age of 16 preclude the grant of bail.
  • Whether the conditions imposed are sufficient to safeguard the investigation and trial.
