Holding
The Court held that the delay in filing the first appeals is condoned subject to payment of costs and an undertaking not to claim statutory benefits or interest.
Summary
The original claimants, who were agriculturists whose lands were acquired, filed several civil applications seeking condonation of delay in filing their first appeals against the acquisition proceedings. The Court examined whether the delay could be excused and under what conditions. It held that the delay may be condoned provided the applicants deposit a cost of Rs. 2,000 each to a designated charitable fund and execute an undertaking not to claim any statutory benefits or interest for the period of delay. Accordingly, the applications were allowed, the delay was condoned, and the first appeals were ordered to be registered. The civil applications were thereafter disposed of.
