Bombay High Court

GUNDAPPA MADHAV BAWGEversusTHE STATE OF MAHARASHTRA THROUGH THE COLLECTOR LATUR AND ANR

Disposal
Admitted/Allowed/Granted/Rule Absolute

Holding

The Court condoned the delay and allowed the applications, subject to payment of costs and an undertaking not to claim statutory benefits or interest.

Summary

The original claimants, who were agriculturists whose lands had been acquired, filed several civil applications seeking condonation of delay in filing their first appeals against the acquisition. The Court examined whether the delay could be condoned and whether the claimants could still claim statutory benefits and interest for the period of delay. It held that the delay could be condoned provided the claimants paid a cost of Rs.2,000 each to a designated charitable fund. Additionally, the claimants were required to file an undertaking that they would not claim any statutory benefits or interest arising from the delay. The Court allowed the civil applications, ordered the registration of the first appeals, and subsequently disposed of the applications.

Issues considered

  • Whether the delay in filing the first appeals against land acquisition can be condoned under the applicable procedural law.
  • Whether the claimants may claim statutory benefits and interest for the period of delay after condonation.
