- DISMISSED
Holding
The High Court dismissed the appeals, finding no basis to intervene in the Reference Court’s compensation award.
Summary
The Executive Engineer, Kukadi Left Bank Canal, appealed to the Aurangabad Bench of the High Court of Bombay against a judgment and award dated 11 February 2011 passed by the Reference Court in L.A.R. Nos.516‑519 of 2003, contending that the compensation awarded was excessive. The State of Maharashtra relied on a Government Resolution dated 3 November 2016 (with subsequent corrigenda) which stipulated that it would not challenge the reference court’s award if the compensation was enhanced only up to four times the amount fixed by the State Land Acquisition Officer. The Court examined whether there was any ground to interfere with the Reference Court’s award and found none, noting the State’s clear policy not to contest such enhancements. Consequently, the appeals were dismissed, the pending civil applications were disposed of, and the Court affirmed the entitlement of the claimants to interest under Section 34 of the Land Acquisition Act, 1894. The judgment thus upheld the original compensation and ordered interest from the date of award.
Issues considered
- Whether the High Court should interfere with the Reference Court’s award of compensation in the land acquisition proceedings.
- Whether the State’s Government Resolution limiting challenges to compensation enhanced up to four times bars any further judicial intervention.
