AU Small Finance Bank LtdversusThe State of Maharashtra

Disposal
DISPOSED OFF

Holding

Since the respondents have agreed to hand over possession, the contempt petition is no longer maintainable and is disposed.

Summary

The petitioner, AU Small Finance Bank Ltd, filed a contempt petition alleging that the State of Maharashtra authorities had failed to hand over possession of a property despite a prior court order dated 16/09/2025. The court noted that the respondent's Advocate General indicated that possession would be handed over the next day with police assistance. Given this compliance, the court found that the purpose of the contempt petition was satisfied. Consequently, the petition was deemed no longer maintainable. The contempt petition was therefore disposed of.

                      DATED : 28/01/2026
P. C. :

1. Under the order of this Court dated 16/09/2025 passed in
Writ Petition No. 7920 of 2025, the respondents- authorities were
directed to cooperate in handing over possession to the petitioner

that, despite the said directions, the respondent authorities did not
take steps to hand over possession.
2. Learned AGP, on instructions, submits that the possession is
scheduled for tomorrow and that the respondents - authorities
shall provide police aid and the concerned authorities are ready to
hand over possession to the petitioner.
3. In view of the above, the purpose of filing the present
contempt petition stands satisfied and nothing survives therein.
Accordingly, the contempt petition stands disposed of.
