Holding

The Court held that the contempt petition was in fructuous and therefore disposed of.

Summary

Petitioner Jaidrath Mahadeo Gaikwad filed a contempt petition (Contempt Petition No. 373 of 2014) against V. Giriraj, Secretary, Rural Development and Water Conservation Department, Mumbai and others. The petition sought relief on the ground of alleged contempt of court. The learned counsel appearing for the petitioner, on instructions, submitted that the petition had become in fructuous. The Court considered whether the petition remained maintainable in view of this submission. Relying on the counsel's statement, the Court concluded that there was no longer any cause of action. Consequently, the petition was disposed of without further hearing. The order was pronounced by a bench of Justice Sandipkumar C. More and Justice Abasaheb D. Shinde on 18 March 2026.
