The petitioners are not entitled to rental compensation and the petition is dismissed.

Summary

The petitioners, BHAURAO SHRIPATI PAWAR alias POKALE and another, filed a contempt petition seeking rental compensation. The respondents submitted an affidavit indicating that interest under Sections 34 and 28 had already been paid to the farmers, rendering them ineligible for further rental compensation. The Court examined the applicability of the procedure for claiming such compensation and found that the compensation had already been provided. Consequently, the petitioners were not entitled to any additional rental compensation. The Court therefore disposed of the petition, finding no surviving claim.

                                             ...
Addl. GP for Respondent/State : Mr. P.S. Patil

                                                               VAISHALI PATIL-JADHAV,JJ.

                                               DATE : 27.07.2026

                 P.C. :
                 1] None for the petitioners.
2] Though the directions were to decide the
application of the petitioners claiming rental compensation
but on going through the affidavit-in-reply filed by
respondent no.4, it appears that since the interest amount
under Sections 34 and 28 is already paid to the concerned
farmers/petitioners, they are not eligible to claim rental
compensation as per procedure laid down. Further it appears
that the compensation is already given to the
                 petitioners/farmers.
3] In view of the same, when the petitioners are not
held entitled for getting rental compensation, nothing
survives in this petition and it stands disposed of.
