Bombay High Court

DNYANOBA BAPURAO JAGTAP AND OTHERSversusTHE STATE OF MAHARASHTRA AND OTHERS

Disposal
DISPOSED OFF

Holding

The contempt petition is dismissed as the rental compensation order has been issued and presumably complied with.

Summary

The petitioners filed a contempt petition alleging that the State of Maharashtra had failed to pay rental compensation ordered on 03/11/2015. The respondents, through their Advocate General, submitted that the compensation order had already been issued and that directions for payment had been given to the concerned authority. The court noted that the petitioners were absent and that the compensation was likely already paid. Consequently, the court found no basis for contempt. The petition was therefore disposed of.

Issues considered

CORAM : SANDIPKUMAR C. MORE AND
                                                  ABASAHEB D. SHINDE, JJ.

                                          DATED : 28/04/2026
            P. C. :

            1. None for the petitioners.

            2. The learned AGP submits that, as per the order dated
03/11/2015, the necessary order has already been passed for
determination of rental compensation payable to the petitioners. It
further appears that directions were also issued to the concerned
authority for payment of such rental compensation. Since the
petitioners have remained absent, it appears that the said
compensation may have been paid to them. In view of the same, the
            contempt petition stands disposed of.
