The interim application seeking preservation of CCTV footage is disposed as the same relief has already been granted by the 49th Judicial Magistrate.
Summary
Petitioner Prashant S. Kokane applied for a certificate to appear in person and sought preservation of CCTV footage of an incident dated 17-20 March 2025. The petitioner also filed an interim application (No. 1946 of 2026) requesting the same preservation. The Court noted that the petitioner had already approached the 49th Judicial Magistrate, First Class at Vikhroli, which had ordered preservation of the CDR on 18 June 2026. Since the relief sought in the interim application had already been granted by the lower court, the High Court disposed of the interim application. The petition was listed for hearing on 15 July 2026 before the Urgent Supplementary Board, and the police were directed to ensure the CCTV footage remains preserved.
Issues considered
- Whether the High Court should order preservation of CCTV footage when a lower court has already granted such an order
- Whether the interim application seeking preservation of evidence is maintainable after the same relief has been granted by the Judicial Magistrate
Subjects
- preservation of evidence
- CCTV footage
- interim relief
- criminal writ petition
- High Court procedural order
