DEEPAK LAKSHMAN SUPUGADEversusTHE DISTRICT COLLECTOR SATARA

Disposal
Disposed Off

Holding

The writ petition is restored to the court’s file subject to the petitioner removing all objections within eight weeks.

Summary

The petitioner, Deepak Lakshman Supugade, filed an interim application seeking restoration of Writ Petition (Stamp) No.15646 of 2024, which had been dismissed for non‑prosecution by orders dated 16 August 2024 and 2 September 2024. The court examined whether a dismissed petition could be revived despite the lapse in prosecution. Relying on the merits of the interim application, the judges held that restoration was permissible but subject to a compliance condition. Accordingly, the writ petition was restored to the court’s file on the condition that the petitioner remove all objections within eight weeks from the date of the order. No order as to costs was made, and the interim application was disposed of.
