ATUL HIRALAL VORAversusTHE DIVISIONAL MANAGER

Disposal
Disposed Off

Holding

The Letters Patent Appeal was dismissed as there was nothing left to adjudicate following the final disposal of the underlying proceedings.

Summary

The appellant, Atul Hiralal Vora, filed a Letters Patent Appeal (LPA) challenging an order dated 26 August 2011 that granted the sixth respondent six weeks to produce a certificate issued by the Commissioner under the third proviso of Section 30(1) of the Workmen’s Compensation Act, 1923. The order was made in the course of Cross Objection (St) No. 4546 of 2011 and First Appeal No. 666 of 2010. Respondent counsel, Mr. I. M. Khairdi, informed the Court that both the cross objection and the first appeal had already been finally disposed of. The Court observed that, since the underlying proceedings were concluded, there was no remaining issue for the Letters Patent Appeal to address. Consequently, the Court held that the LPA could not proceed and was deemed disposed of. The appeal was therefore dismissed.

Issues considered

  • Whether any relief remains for the appellant in the Letters Patent Appeal after the underlying cross objection and first appeal have been finally disposed of.
