Bombay High Court
PRALHAD NAGORAO LOLAMWADversusTHE STATE OF MAHARASHTRA AND OTHERS
- Disposal
- DISPOSED OFF
Holding
The Court quashed the Scrutiny Committee’s order denying the petitioner’s Scheduled Tribe status and directed issuance of a validity certificate subject to specified conditions.
Summary
The petitioner, Pralhad Nagorao Lolamwad, challenged a judgment of the Scrutiny Committee that denied his claim to belong to the Mannervarlu Scheduled Tribe. He argued that the same order had been successfully contested by other claimants in Writ Petition No. 10052 of 2025, resulting in a conditional validation by the Court. The State’s Attorney General did not dispute the petitioner’s relationship to those validated claimants. The Court examined whether the earlier validation extended to the petitioner and found that it did, leading to the quashing of the impugned order. Consequently, the Court directed the Scrutiny Committee to issue a caste validity certificate to the petitioner, subject to conditions including re‑verification of relatives’ certificates and an undertaking not to claim service benefits if the validity is later revoked.
Issues considered
- The validity of the petitioner’s claim to belong to the Mannervarlu Scheduled Tribe
- Whether the earlier conditional validation in Writ Petition No. 10052 of 2025 extends to the petitioner
- Whether the impugned order of the Scrutiny Committee should be quashed
